The process begins with you selecting what day is best for your VIP day. Spots are limited so make sure you schedule as soon as you know you are ready to get your trademark application filed.
COMPLETE YOUR PRE-VIP DAY ONBOARDING DOCUMENTS
Next you will pay your invoice, sign the agreement to allow me to be your attorney of record, and fill out the questionnaire. That is all I will need to get ready for your VIP Day!
EXTENSIVE SEARCH & OPINION LETTER
On your VIP Day, the process begins with an extensive search to determine whether or not your name is available. This is more than just a google search or a knockout search on the USPTO website. We generate a report of over 100 pages and analyze it to determine your chances of getting your mark registered. I then will provide you with a letter giving my expert opinion on the likelihood of your mark getting filed and my recommendation on whether to move forward or not. We will also discuss the findings on a 15-30 minute call to make sure you have complete understanding before moving forward with your application.
CLASS DETERMINATION, CLASS DESCRIPTION & SPECIMEN CREATION
Next, based on our discussion and your questionnaire, I will do a class determination and specimen creation to include with the application which I will fill out and file. If necessary, we may need to get on another 15 minute call to review the classes before I fill out and file the application.
APPLICATION PREPARATION & FILING
Lastly, I fill out and submit your application and your VIP Day is complete! Go cross “trademark” off of your to-do list!
After your VIP Day
OFFICE ACTION RESOLVE
Within 4-5 months an examining attorney will be assigned to your matter and will review the application and respond with any office actions. Office actions are complications, issues, or clarifications needed in regards to your mark that need to be addressed before your mark can move forward. These are handled by me and I will communicate with and respond to the examining attorney.
PUBLICATION & NOTICE OF ALLOWANCE
The next step is the publication period. This is when your mark is published for opposition, meaning that anyone who thinks they have rights to the name you are trying to trademark can petition to stop you from getting your mark registered. Although this isn’t common, and we try to avoid any opposition by completing the thorough search in step 1, it does occasionally happen.

+ What are the Federal Filing fees and are they included in the VIP Day?
Federal filing fees are $350. These fees are for each class of goods/services you are filing in. One class of goods/services is included in the trademark VIP Day. Any additional classes you wish to file in will be an additional charge approved by you prior to filing.
+ What is the time committment required by me on the VIP Day?
Less than 2 hours! We will have (2) 15-30 minute calls scheduled to discuss findings before filing the application. You will also have to be available to respond to emails and approve documents within 15 minutes of receiving them. Otherwise I will handle everything else. The process is painless on your end and not a big time committment.
+ How long does it take?
Your application will be filed on your VIP Day and you will receive confirmation of the filing and a copy of the application for your records. The trademark process takes between 8-18 months. Once your application is filed it takes 4-5 months for an examining attorney to be assigned to your mark and the process will move along from there.
+ Does this mean my trademark will be registered on my VIP Day?

+ Do you guarantee my trademark will be registered?
No, there is no way any attorney can ever guarantee a registration as each application is evaluated on a case by case basis by an examining attorney assigned by the US Patent and Trademark Office. We do our best to increase the chances of registration through the search process but nothing is ever guaranteed.
+ When is the right time to trademark?
The time to trademark was yesterday. The second best time is right now. With more businesses being started and more applications being filed with the USPTO than ever before, the chances of getting your mark registered is getting harder and harder. The sooner you can file your mark, the better.

+ I’m not in South Carolina, can Alli still file my trademark for me?
YES! Trademarks are governed by federal law therefore you do not need to be in the same state as Alli to have her file your trademark.
